INDIANAPOLIS, Ind. (ADAMS) – Proposed legislation to make animal cruelty a Level 5 felony in Indiana is not advancing. Senate Bill 41 failed to advance from a Senate committee that voted on it last week.
That means animal cruelty will remain a Level 6 felony in Indiana, which is punishable by a prison sentence ranging from six months to two and a half years.
Senators who opposed the measure were concerned over how raising the punishment for one offense would call into question the punishment of others on the same felony level, a potential issue known as cascading offenses.
