INDIANAPOLIS, Ind. (ADAMS) – Indiana lawmakers told the state’s Supreme Court that Governor Holcomb’s argument against their emergency powers limit doesn’t add up.
Lawmakers and lawyers for the governor made their arguments to the court on Thursday.
Governor Holcomb’s lawyers say the state constitution does not mention anything about the special session that lawmakers used to approve the law.
Therefore, they say, the law is unconstitutional.
Lawyers for the legislature say the governor is grasping with that argument, and say the separation of powers in the state allows for the legislature to set its own rules and call for its own session days.
The arguments will decide the fate of the law that Indiana lawmakers pushed through to contain the governor’s ability to declare another long-lasting emergency like he did during the coronavirus.
